Philips wants Xiaomi banned from selling phones, files Delhi HC case alleging patent infringement
Philips has contacted the Delhi High Court to ask Xiaomi to ban the sale of its phones that infringe their patents. The Philips case seeks not only to ban the sales, but also the manufacture, assembly, import and advertising of Xiaomi products on its own websites and other third party websites.
The company wants to ban some Xiaomi phones that include UMTS (HSPA, HSPA +) and LTE enhancement technologies, according to reports, because they infringe certain patents.
In its plea, Philips applied for an interim injunction order directing the Central Board of Excise and Customs to allow customs authorities at all Indian ports not to allow importation of Xiaomi phones, especially the models specified in the file submitted.
<< It is specified that the defendants are bound by the declaration of their counsel. Defendants will be required to file details of bank accounts operated in India where the amount of Rs 1,000 crore is maintained, no later than December 2, 2020, said the Delhi HC order of November 27.
The court will hear the case on January 18 next and there should be more clarity on the issue then.
Xiaomi has yet to release any statement on this matter.
